What Ever Happened to the Wines 'Til Sold Out Class Action Lawsuit?
Our previous blog post about Wines 'Til Sold Out explains the case where the Plaintiffs alleged that because certain wines were not sold anywhere for the purported "Original Price," the discount advertised by WTSO was not real, and consumers were not buying wines at a discount after all.
Some of the wines potentially affected were from Bell Canyon Cellars, Canyon Creek Winery, Clifford Bay, Curlew, Herringbone, John Williams Vineyards, Kingsford Manor, Iron Door and Pruet.
On August 13, 2018, the Plaintiffs dismissed their lawsuit. Under the terms of the proposed settlement, those of us who were affected completed Verification Forms to receive credits toward future purchases from WTSO. While that settlement did not obtain court approval, they have agreed to provide us the same credits we would have earned under the agreement provided we agree to release substantially the same claims that would have been released had the settlement been approved. Those of you who submitted the Verification Forms should receive an email with a link to activate your credit code.
When you click the link in their email, it will tell you how many dollars worth of credits you have of the estimated $10.8 million believed to be involved. For example, He and She will receive a $2 credit off each bottle we purchase from WTSO until our credits are all used up (excluding some wines for which the credits cannot be used due to legal restrictions, special promotions or marathons).
You must agree to the Terms of Use of Credits to obtain your code. The discount codes will expire on August 15, 2019.
